1. Overview
These Terms of Service govern the provision of marketing support services by Presence Management Co. (“we”, “us”, “our”) to the client (“you”, “your”).
By purchasing or subscribing to our services, you agree to these Terms.
2. Service Model
We provide marketing support through a monthly service model based on allocated production time.
Each plan includes a set number of days per month dedicated to your marketing. This time is used to complete tasks requested by you or otherwise agreed.
This is a time-based service, not a deliverables-based service. Outputs will vary depending on scope, complexity, and the time available within your selected plan.
Work is executed within the time available in your plan, not based on a predefined list of deliverables.
3. Plan Levels and Priority
Plans differ by:
• the amount of time included each month
• the priority level given to your work
Higher-tier plans include more production time and are prioritised within our production schedule.
4. Requests and Work Allocation
You may submit marketing-related requests for us to complete within your selected plan.
We will use the time included in your plan to complete work within each billing period.
If the amount of work requested exceeds your available time, we may:
• recommend upgrading to a higher plan,
• continue remaining work in the following billing period where your subscription is active, or
• offer additional capacity at a daily rate for earlier completion
Submission of tasks does not guarantee all requested work will be completed within a single month.
We retain discretion over how work is scheduled and delivered.
5. Scope of Service
We support a range of marketing-related execution, including content, website updates, campaigns, and general marketing work.
We may decline or defer work that:
• falls outside the scope of this service
• is excessively technical or specialised
• is better suited to a defined project
• is not appropriate for this service model
6. Strategy and Project Work
More in-depth strategy or defined project work may be quoted separately.
7. Client Responsibilities
To enable effective delivery, you agree to:
• provide clear instructions and priorities
• supply required access, assets, and information
• ensure all provided materials are accurate and lawful
Delays in receiving required inputs may affect what can be completed within your monthly allocation.
8. Unused Time
Unused time does not roll over unless agreed otherwise.
Your plan covers production capacity within the active billing period only.
9. Billing and Payment
All plans are billed monthly in advance.
Payments are non-refundable once a billing period has commenced.
Subscriptions renew automatically unless cancelled.
We may pause or stop work if payment is not received.
10. Cancellation by You
You may cancel at any time.
Cancellation takes effect at the end of your current billing period.
Any incomplete or remaining work does not carry over once your plan ends.
To cancel, simply contact us via email.
11. Pricing Changes
We may update our pricing from time to time.
Any changes will apply to future billing periods and will not affect your current billing cycle.
12. Refusal of Service and Termination
We reserve the right to refuse service, decline to take on a client, or terminate a working relationship at any time, for any reason.
This includes situations where:
• the working relationship is not a good fit
• communication becomes difficult or unproductive
• expectations fall outside the scope of the service
• boundaries are not respected
• requests are excessive relative to the selected plan
We are not obligated to continue working with any client.
13. Availability and Turnaround
This is not an on-demand or instant service.
Work is scheduled within our production calendar and completed based on:
• your selected plan
• your priority level
• current workload
14. Intellectual Property
Upon full payment, final work created specifically for your business is yours to use.
We retain ownership of all underlying systems, methods, templates, and processes.
15. Third-Party Platforms
We may work within third-party platforms as part of delivering the service.
We are not responsible for outages, changes, or issues within those platforms.
16. No Guarantee of Results
We provide marketing support only.
We do not guarantee specific outcomes, including leads, revenue, or performance results.
17. Limitation of Liability
Our liability is limited to the amount paid for your current billing period.
We are not liable for indirect or consequential losses.
18. Legal Entity
Presence Management Co. is a trading name of Portia Jackson. All services are provided by this entity.
19. Updates
We may update these Terms at any time. The latest version on our website applies.
